Special Notes / Conditions

1. Charges
Additional services and charges are agreed separately. The tourist tax will be collected for the stay and this amounts Euro 2 per person /day.
2. Arrival and departure
Arrival normally between 4 pm and 6 pm or according to agreement. If the tenants expect to arrive later than at 6 pm, the tenants shall inform the owner or his representative about the exact arrival time. In case of delay the tenants shall inform the owner or his representative. – Departure shall take place no later than 10 am on the departure date.
3. Our responsibilities
Le Haut des Espinets is responsible for the condition of the property and its furniture. Le Haut des Espinets is not liable for any changes which do not affect the villa directly (e.g. swimming possibilities at the beach, shops etc., road and building construction, delays during transportation, environmental damage etc.)
4. Cancellation/Illness insurance
Travel Insurances in connection with cancellation, delays, illness and likely, is at the responsibility of  the tenant and extraneous for Le Haut des Espinets.
5. Capacity
The number of individuals provided in the agreement may not be exceeded without agreement with Le Haut des Espinets. Children/babies (from age 10 months) always count as persons in the capacity. Every useful event (wedding, receptions, birthdays…) must have the agreement of the owner. Tenants are not allowed to bring in additional beds. Similarly, setting up tents or parking trailers in the garden is prohibited. If those rules are not respected and the owner note that the capacity is exceeded it is the owner’s right, without any warning, to cancel the rental agreement and turn out all tenants. The tenants are in this case not entitled to any compensation.
6. Pets
This has to be specified in the contract. When pets are brought along the accommodation has to be left without traces of the pet even if the final cleaning is included or the tenant has paid the final cleaning (e.g. thorough vacuum-cleaning during the stay as well as at the departure).
7. Tenant’s obligations
The tenant s shall return the villa in the condition it was at arrival. If this is not done, the tenant shall be billed the cost of repairs. Eventually damages shall be notified to Le Haut des Espinets.
Final cleaning shall always be done by Le Haut des Espinets. It is the tenant’s obligation to: wash the dishes, empty the garbage bags, clean the refrigerator and oven.
The tenant declares that the tenants will not make any claims against Le Haut des Espinets, in case of personal damages on the property and the use of swimming pool. We hereby notice that supervision of the swimming pool is the tenant’s responsibility.
The security deposit shall be returned after the rental period if the house is left in a proper an undamaged condition. The tenant’s responsibility for damages etc. is preserved even though it exceeds the amount for the paid security deposit.
The tenant is liable for eventual theft, damage or loss of personal effects in case of failure or breakdown of any of the holiday homes installation, theft etc.

8. Complaints
Any claims in connection with the rental property has to be made within 48 hours of occupying the premises, and informed by telephone, e-mail or letter to Le haut des Espinets.
In the event of a dispute, the court in Nice, France, alone has jurisdiction.
9. In general
Since this rental is made solely on a seasonal basis, the tenant undertakes to vacate the premises upon the date provided in the agreement. More over, the tenant’s domicile is his address as indicated in this agreement.
10. Force majeure
The tenant still has to pay the full rental amount in case of force majeure (accidents, strikes, lock outs, nature catastrophes, war, epidemic diseases etc.) that makes it impossible to fulfil the rental agreement. This is also the case regarding the personal situation at the tenants. Le Haut des Espinets will cancel the agreement, if the villa not is usable due to force majeure. In that case paid rental fee will be refunded.
11. Price structure additional rooms
The agreement defines the number of persons staying in the villa and the number of rooms to be used. A maximum of 10 persons can stay in 5 double rooms. – If you have less than that, you can book additional room(s) at a rate of Euros 500 per week, including additional cleaning, towels, etc.

FAIR (60 days)
If the Property Owner/Manager applies a Fair Cancellation Policy, the Renter can cancel up to 60 days prior to the start of the Tenancy. Cancellation requests must be made in writing and received by the Property Owner/Manager, and AA, at least 60 days before the start of the Tenancy. The Renter will receive a 50% refund of the total booking value generated on AA, less the non-refundable commission fee.
